{"id":1709,"date":"2026-01-07T09:27:42","date_gmt":"2026-01-07T09:27:42","guid":{"rendered":"https:\/\/curmexcarrentals.com\/?page_id=1709"},"modified":"2026-01-07T09:31:00","modified_gmt":"2026-01-07T09:31:00","slug":"vehicle-damage-waiver-limitation","status":"publish","type":"page","link":"https:\/\/curmexcarrentals.com\/de\/vehicle-damage-waiver-limitation\/","title":{"rendered":"Vehicle Damage Waiver &amp; Limitation"},"content":{"rendered":"<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><em>(Cura\u00e7ao \u2013 Non-Insurance Contractual Protection)<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IN-HOUSE VEHICLE DAMAGE WAIVER &amp; RISK LIMITATION AGREEMENT<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. LEGAL NATURE AND QUALIFICATION<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This In-House Vehicle Damage Waiver and Risk Limitation Agreement (\u201cAgreement\u201d) is a contractual arrangement between Curmex Car Rental N.V. (\u201cCompany\u201d) and the renter (\u201cRenter\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Agreement:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not constitute an insurance policy within the meaning of Cura\u00e7ao insurance legislation;<\/li>\n\n\n\n<li>does not involve risk transfer to a licensed insurer.<\/li>\n\n\n\n<li>constitutes a contractual waiver and limitation of the Company\u2019s right to recover vehicle damage from the Renter, subject to the terms and exclusions herein.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Mandatory third-party liability insurance (WA) is provided separately and remains fully governed by mandatory Cura\u00e7ao law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. SCOPE OF APPLICATION \u2013 AUTHORIZED DRIVERS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Protection applies exclusively when the vehicle is operated by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Renter; and<\/li>\n\n\n\n<li>any additional driver expressly listed in the Rental Agreement,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">provided each driver:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>holds a valid and legally recognized driver\u2019s license in Cura\u00e7ao; and<\/li>\n\n\n\n<li>complies with all qualification requirements of the Company.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any deviation results in full contractual liability of the Renter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. COVERED DAMAGE (SUBJECT TO EXCLUSIONS)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subject to Section 4, the Company waives its right to recover damage costs for accidental physical damage or loss of the vehicle caused by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>collision or rollover;<\/li>\n\n\n\n<li>fire, explosion, or lightning;<\/li>\n\n\n\n<li>theft or attempted theft;<\/li>\n\n\n\n<li>vandalism or malicious damage.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. EXCLUSIONS \u2013 NO WAIVER APPLIES IN CASE OF:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Protection does not apply, and the Company retains full recovery rights, if damage or loss results from:<\/p>\n\n\n\n<ol style=\"list-style-type:upper-alpha\" class=\"wp-block-list\">\n<li>Driver Conduct:<\/li>\n\n\n\n<li>driving under the influence of alcohol, drugs, or intoxicating substances;<\/li>\n\n\n\n<li>driving without a valid license;<\/li>\n\n\n\n<li>allowing unauthorized drivers;<\/li>\n\n\n\n<li>gross negligence, recklessness, or intentional misconduct;<\/li>\n\n\n\n<li>violation of traffic or criminal laws.<\/li>\n\n\n\n<li>Improper or Prohibited Use:<\/li>\n\n\n\n<li>racing, competitions, speed testing;<\/li>\n\n\n\n<li>illegal use; use outside Cura\u00e7ao or outside permitted areas;<\/li>\n\n\n\n<li>subleasing or lending the vehicle.<\/li>\n\n\n\n<li>Specific Damage Categories:<\/li>\n\n\n\n<li>normal wear and tear; mechanical or electrical failure not caused by an accident;<\/li>\n\n\n\n<li>tire or rim damage unless occurring simultaneously with other covered damage;<\/li>\n\n\n\n<li>interior damage due to misuse, negligence, water, sand, animals, or smoking;<\/li>\n\n\n\n<li>lost or damaged keys unless resulting from a reported theft;<\/li>\n\n\n\n<li>personal property of the Renter or passengers.<\/li>\n\n\n\n<li>Theft-Related Negligence:<\/li>\n\n\n\n<li>vehicle left unlocked;<\/li>\n\n\n\n<li>keys lost, abandoned, or negligently handled;<\/li>\n\n\n\n<li>failure to take reasonable precautions against theft.<\/li>\n\n\n\n<li>Excluded Losses:<\/li>\n\n\n\n<li>bodily injury, medical costs, or death (covered solely under mandatory WA insurance where applicable);<\/li>\n\n\n\n<li>fines, penalties, or administrative sanctions; loss of use, loss of rental income, or downtime, which shall remain contractually recoverable from the Renter;<\/li>\n\n\n\n<li>war, civil unrest, nuclear risks, or terrorism.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. DEDUCTIBLE (EXCESS)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each covered incident is subject to a deductible of USD 250.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Company waives recovery of damage exceeding this amount, provided full compliance with this Agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6. RENTER OBLIGATIONS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of damage, accident, or theft, the Renter must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>notify the Company immediately or within 24 hours;<\/li>\n\n\n\n<li>obtain a police report in cases of theft, injury, or third-party involvement;<\/li>\n\n\n\n<li>refrain from repairs without Company approval (except emergencies).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Failure to comply entitles the Company to full recovery of damages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7. DURATION<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Protection applies only during the rental period and only while the vehicle is used in full compliance with the Rental Agreement and this Agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>8. COST<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Optional Protection fee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>USD 20 per day (economy\/compact);<\/li>\n\n\n\n<li>USD 25 per day (all other classes).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;9. GOVERNING LAW AND JURISDICTION<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Agreement is governed by the laws of Cura\u00e7ao.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All disputes fall under the exclusive jurisdiction of the courts of Cura\u00e7ao.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>10. ACCEPTANCE<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By signing the Rental Agreement, the Renter expressly confirms:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>receipt and understanding of this Agreement;<\/li>\n\n\n\n<li>acceptance of its contractual nature;<\/li>\n\n\n\n<li>acknowledgment that this is not insurance.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Customer Signature&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Checker-in Signature<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Order number:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Date:<\/p>","protected":false},"excerpt":{"rendered":"<p>(Cura\u00e7ao \u2013 Non-Insurance Contractual Protection) IN-HOUSE VEHICLE DAMAGE WAIVER &amp; RISK LIMITATION AGREEMENT 1.
