- Fuel policy:
The Vehicle will be provided with a full tank of fuel and must be returned with the same. Failure to comply will result in a refueling charge, including the local fuel price and a fixed service fee of US$ 15.00.
- Return Obligation:
The Vehicle must be returned to the Lessor on the agreed date and time unless an extension is approved in advance.
- Late return:
The Vehicle must be returned as scheduled. A late fee of US$ 5.00 per hour will be charged for the first 12 hours after the rental period ends. Beyond that, the full daily rental fee applies for each additional day. Charges may be deducted from the security deposit.
- Extension Policy:
Extensions must be requested at least one day before the rental period ends. Approval is subject to availability and is not guaranteed.
- Damage or Loss:
The Lessee is responsible for any theft, damage, or loss of the Vehicle during the rental period. Repair costs, up to the Vehicle’s current value, must be covered by the Lessee. In the event of total loss, the Lessee will pay the Vehicle’s current value. If no pre-rental damage report is documented, the Vehicle is assumed to be in undamaged condition. Insurance agreements do not absolve the Lessee of liability.
- Indemnity:
The Lessee will indemnify the Lessor for any damages, losses, legal claims, or attorney fees resulting from their use of the Vehicle. This obligation survives the termination of the Agreement.
- Lessor Warranty:
The Lessor guarantees that the Vehicle is in safe and operable condition, free of known defects that could affect its safe use under normal circumstances.
- Security Deposit:
A security deposit of US$ 150.00 (for drivers aged 23 or older) or US$ 350.00 (for drivers under 23) is required. Costs for damages, repairs, or penalties will first be deducted from this deposit. Any additional costs are the responsibility of the Lessee.
- Insurance:
The Lessee must maintain insurance for personal injury and property damage. Lessor-provided insurance includes third-party liability coverage. Upgraded all-risk insurance is available for an additional daily fee of US$ 10.00 (economy/compact cars) or US$ 15.00 (SUVs).
- Smoking Policy:
Smoking is prohibited in the Vehicle. Violations will result in a US$ 50.00 cleaning fee, deductible from the security deposit.
- Vehicle Operation:
The Lessee is the sole authorized driver unless otherwise agreed. Additional drivers incur a fee of US$ 10.00 per day. The Lessee remains liable for any damages or losses.
- Repairs:
Minor repairs are the Lessee’s responsibility unless due to the Lessor’s maintenance failure. Repairs must be conducted at the Lessor’s facility or an approved garage, with prior approval. Excessive interior dirtiness may result in a US$ 25.00 cleaning fee, deducted from the security deposit.
- Damage Liability:
The Lessor is not liable for defects not caused by negligent maintenance. Liability is limited to known defects that could have been reasonably addressed at the time of the Agreement.
- Seizure:
In the event of seizure, the Lessee remains responsible for all payments and must reimburse the Lessor for any related costs.
- Lessee Obligations:
The Lessee must use the Vehicle responsibly, prevent unauthorized use, and comply with applicable laws.
- Termination:
The Lessor may terminate the Agreement if the Lessee fails to fulfill their obligations. The Lessee must assist the Lessor in reclaiming the Vehicle.
- Legal Fees:t
In the event of a legal dispute, the prevailing party is entitled to recover legal fees.
- Binding Agreement:
This Agreement is binding and represents the full understanding between the parties.
- Governing Law:
The Agreement is governed by the laws of Curaçao.
- Amendments:
Any modifications to this Agreement must be in writing and signed by both parties.
